Is Delta-8 THC Legal?

The 2018 Farm Bill modified the definition of tetrahydrocannabinols (“THCs”) in the Controlled Substances Act (“CSA”) to exclude “THCs” in hemp. Delta-8 THC is one of many cannabinoids naturally found within the cannabis plant. The starting concentration of Delta-9 THC in the cannabis plant material and the final concentration of Delta-9 THC in the final product will determine if the Delta-8 THC product is considered marijuana. Therefore, if Delta-8 THC is wholly derived from cannabis with less than 0.3% Delta-9 THC (i.e., hemp) and the final product contains less than 0.3% Delta-9 THC, it is considered a hemp product and is federally legal. The recent DEA IFR, however, has created some uncertainty within the hemp market relating to Delta-8 THC when it is synthesized from CBD isolate. The DEA IFR emphasized that synthetic THCs are not legal. However, it is our position that Delta-8 THC derived from CBD isolate from hemp is still legal because (1) the 2018 Farm Bill legalized hemp and all its derivatives; and (2) “synthetic” in this context generally refers to THC created entirely in the lab as opposed to being derived from a natural legal product like hemp. But you still need to make sure that the Delta-8 THC products are compliant with FDA regulations and state law.

Will hemp products show up in a drug test?

Will hemp products show up in a drug test?

CBD products are unlikely to appear in a drug test. A user is screened for THC (the psychoactive cannabinoid) in a drug test. CBD is a separate cannabinoid from THC, therefore, CBD should not appear on a drug test. Yet, if a CBD product contains trace amounts of THC within the product, THC could appear in a user’s drug test. We do not make any guarantees regarding drug tests, and consumers should use their best judgment before using any CBD product.Delta-8 THC is likely to appear in a drug test. Although Delta-8 THC derived wholly from hemp is federally legal, all THC molecules will break down into THC metabolites within the body. As a result, Delta-8 THC will look the same on a drug test as Delta-9 THC. Therefore, consumers should use their best judgment before using any Delta-8 THC product.


Can pregnant or nursing moms use your products? Or someone using prescription medication?

Any pregnant or nursing mothers, individuals with known medical conditions or taking prescription medications should consult a physician before taking.

How Is This Legal?

The Hemp Farming Act of 2018 was a proposed law to remove hemp (defined as cannabis with less than 0.3% Delta-9 THC) from Schedule I controlled substances and making it an ordinary agricultural commodity. Its provisions were incorporated in the 2018 United States farm bill that became law on December 20, 2018.

​CBD, CBG, CBN, CBC, CBL, Delta-8 THC, and all products on our website are derived from federally legal hemp. This means, they are federally legal, thanks to the Farm Bill of 2018.

Each state has their own laws relating to legality of hemp-derived products. It is your responsibility to know whether these products are safe in your respective state.


What should I consider when buying hemp products?

Quality – Look for the highest quality raw materials and extraction methods.

 Farming – Make sure the products you choose are from domestic hemp farms with agricultural quality standards.

We do not handle refunds for purchases made at independent retail locations. If you purchased a Nitrobliss product at a retail location, or through a website other than ilovenitrobliss.com you will need to deal directly with the store or website where you made the purchase, as we have no way to monitor what they do with our products after we ship to them.

If you purchased from http://www.ilovenitrobliss.com  and something is wrong with your purchase you may be entitled to a refund as long as we are notified within 10 days. Refunds are not guaranteed and no returns will be given if you have not contacted us within 10 days of your purchase.

While we stand behind the quality of our products, the effectiveness of a product is not a valid reason for refund, as cannabinoids affect everyone differently.

We charge a flat rate for shipping. We send all our products out via USPS priority mail. All orders before 3:00pm will be shipped the follow day.
